1. Introduction

Welcome to Probalist ("we," "us," or "our"). These Terms & Conditions govern your access to and use of our website at https://www.probalist.com and our TradingView indicator suite (collectively, the "Services").

By accessing, browsing, registering, or engaging in any transaction through our Services, you willingly acknowledge, accept, and agree to be bound by these Terms. You confirm that you possess the legal authority to enter into this agreement. If you do not agree, do not access or use our Services.

In addition to these Terms, you are also bound by our Privacy Policy. By agreeing to these Terms, you also consent to the data practices described there. We reserve the right to modify these Terms at any time. Continued use of our Services after changes are posted constitutes your acceptance.

2. Description of Services

Probalist provides professional TradingView indicators in two lines:

• Probalist Essentials — free, open-source indicators published on TradingView under our profile. No registration with us is needed: open a script page on TradingView and add it to your chart. The full Pine Script source code is public.
• Probalist VIP — a premium, closed-source indicator suite offered as a paid subscription, delivered through TradingView as invite-only scripts. Where VIP is available, your TradingView username is granted access after subscribing.

The free Academy content on this website is provided for educational purposes. Occasionally we may collaborate with affiliates or partners on promotions; these Terms apply regardless of the offer chosen.

3. Subscriptions & Renewals (paid plans)

Sections 3–7 apply where you purchase a paid Probalist subscription. Paid subscriptions work on an auto-renewal basis: your subscription automatically renews at the end of each billing cycle unless cancelled beforehand.

You may cancel at any time by contacting us at theprobalist@gmail.com. Upon cancellation your subscription is set to non-renewal: you retain full access until the end of your current paid billing period, and no further charges are applied.

4. Payment Terms

Payments are processed securely through Stripe. We do not store your card details. By subscribing you agree to the following:

• Billing cycles and prices are as displayed at checkout, charged in advance at the start of each cycle.
• Prices are displayed in EUR and may be subject to applicable local taxes.
• Subscriptions renew automatically unless cancelled before the renewal date.
• For payment queries or invoice requests, contact theprobalist@gmail.com.

5. Free Trial

Where a free trial is offered, its duration and conditions are stated at checkout. No charge occurs during a trial period and you may cancel before it ends without being charged. One trial per user.

6. Cancellation & Refunds

You may cancel your subscription at any time by contacting us at theprobalist@gmail.com. Upon cancellation you retain access until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

In exceptional circumstances, refund requests may be considered at our sole discretion. To request a refund, contact us within 7 days of your most recent charge with your order details.

7. Discount Codes & Promotions

Where offered, discount codes are valid for new subscriptions only and apply to the first invoice of the chosen billing cycle. One code per account. Codes cannot be combined with other offers, have no cash value, and expire as stated at the time of issue.

8. Acceptable Use

By using our Services you agree not to:

• Share, resell, or redistribute access to paid (invite-only) Probalist indicators to third parties.
• Republish our open-source indicators in violation of their licence (see Section 9), including stripping attribution or misrepresenting authorship.
• Use our Services for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to our systems.
• Use automated tools to scrape or extract data from our Services.
• Misrepresent yourself or impersonate another person or entity.

Violation of these terms may result in immediate termination of access (including paid subscriptions) without refund.

9. Intellectual Property & Open Source

Essentials (open source): our free indicators are published on TradingView with public source code, licensed under the Mozilla Public License 2.0 as indicated in each script. You may study, use, and build upon them under the terms of that licence, which requires preserving the licence notice and attribution.

VIP (closed source) and all other content: paid indicators, the Probalist name and logo, website content, Academy materials, and designs are our intellectual property. For paid indicators you are granted a limited, non-exclusive, non-transferable licence for your personal trading activities only. Nothing in these Terms grants you ownership of any Probalist intellectual property beyond the rights expressly stated in the applicable open-source licence.

10. Disclaimer of Financial Advice

Probalist indicators are tools designed to assist with technical analysis. They do not constitute financial advice, investment recommendations, or solicitations to buy or sell any financial instrument. Past performance of any signal or indicator does not guarantee future results.

You acknowledge that trading financial markets involves substantial risk of loss and may not be suitable for all investors. Probalist and its team are not responsible for any trading losses incurred through the use of our Services.

11. Third-Party Services

Our Services integrate with the following third-party platforms:

• TradingView — Our indicators are hosted and delivered via TradingView. Use of TradingView is subject to their own Terms of Service.
• Stripe — Payments for paid subscriptions are processed by Stripe. Their privacy policy and terms apply to all payment transactions.
• Anthropic — Our AI chat is powered by Anthropic's Claude API, subject to Anthropic's usage policies.
• Google Translate — Used to provide multilingual support, subject to Google's Terms of Service.
• YouTube — Embedded videos are served by YouTube (privacy-enhanced mode) and load only after you press play, subject to Google's Terms of Service.

We are not responsible for the availability, accuracy, or practices of these third-party services.

12. Limitation of Liability

To the fullest extent permitted by law, Probalist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to trading losses, loss of data, or loss of profits.

Our total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 30 days preceding the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

14. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or a notice on our website. The date at the top of this page reflects the most recent update. Continued use of the Services after changes constitutes acceptance of the updated Terms.
